National Security Experts Highlight Benefits of H-1B Program After Court Ruling

June 12, 2026

Press Release

WASHINGTON – The Council on National Security and Immigration (CNSI) today released a statement responding to Monday's federal court ruling striking down the $100,000 fee on new H-1B visa petitions.

"CNSI welcomes the federal court ruling striking down the exorbitant fee for new H-1B visas. This program remains one of America's most important tools for attracting highly-skilled scientists, engineers, researchers, and innovators whose work strengthens U.S. economic competitiveness and national security, and doctors and nurses who are vital to providing all Americans with access to quality health care.

“Policies that dramatically increase the cost of hiring highly-skilled workers risk driving talent, investment, and research opportunities elsewhere at a time when countries like China and Russia are aggressively competing for the same expertise.

"The current system remains constrained by an outdated visa cap established more than three decades ago, limiting American businesses and workers who would benefit from the contributions of uniquely qualified applicants. We urge the Trump Administration and Congress to work together on reforms that expand the H-1B program, modernize yearly visa caps to reflect labor market needs, streamline processing, and strengthen enforcement against abuse.

"America's long-term strength and security depend in part on its ability to attract and retain the world's best talent. Expanding and modernizing the H-1B program is essential to maintaining U.S. leadership in science, technology, and innovation, and ensuring that America remains the destination of choice for the world's most talented individuals."
